Terms of Use and Conditions - Make Your Travel Platform

This document defines the terms of use, booking terms, and liability framework for using the Make Your Travel platform.

Introduction

Welcome to the Make Your Travel website (the "Website"). The Website is operated by Aroyo Bracha Ltd, company no. 208385190, located at Petar Parchevich 29, Sofia, 1000 (the "Company"). The Website serves as a content, branding, and e-commerce platform offering information and tourism services in Bulgaria, including hotels, day tours, car rentals, attractions, and vacation planning.

1. General Terms and Acceptance

Use of the Website, its content, and the services offered on it is subject to your full agreement with these Terms.

Browsing the Website, placing an order, and/or registering for a trip constitutes a declaration that you have read these Terms, understood them, and agree to all conditions without reservation.

Make Your Travel may update these Terms from time to time. The binding version is the version published on the Website at the time of the relevant action.

These Terms may be written in masculine form for convenience only, and are intended for all genders equally.

Make Your Travel makes its best effort to present accurate information. However, typographical errors or good-faith inaccuracies in product descriptions or pricing may occur and will not bind the Company.

2. Nature of Service and Liability (Intermediary Clause)

Company role: Make Your Travel acts solely as an intermediary connecting users with local service providers (in Israel and abroad) that operate trekking, accommodation, transportation, guiding, and attraction services.

Supplier responsibility: Full and exclusive responsibility for actual service delivery, quality, safety, schedules, and equipment condition lies with the local service providers only.

Inherent risks: The user acknowledges that some activities published on the Website (such as trekking and extreme sports) involve inherent risks. Make Your Travel shall not be liable for bodily injury, illness, property damage, or losses occurring during such activities.

Guides' field decisions: The Company may recommend certified guides but is not responsible for professional real-time decisions made by them (such as route changes due to weather or safety assessments).

3. Insurance Obligation and Health Declaration

Travel insurance (mandatory): Every participant must purchase personal travel insurance for abroad, including medical coverage, baggage coverage, and trip cancellation/shortening coverage. For high-risk activities, participants must ensure their policy includes extreme sports and rescue coverage. The Company will not be responsible for damages that could have been covered by insurance.

Fitness for activity: Participants declare that their health condition and physical fitness are suitable for the relevant activity. The Company may (but is not obligated to) request a signed health declaration.

Activity suspension: A field guide may stop a customer from participating if, in the guide's professional opinion, continuation endangers the customer's health or group safety, without monetary refund.

4. Payment and Accuracy of Details

Payment process: The full amount is due at the time of booking to secure the reservation.

Processing fee: Credit card payments include a 2% processing fee. In case of cancellation and refund, this processing fee is non-refundable, as it is a direct cost borne by the Company with the credit card provider.

Images and information: Images on the Website are for illustration only. Minor changes in schedules or hotels may occur due to operational constraints, weather, or decisions by local authorities.

5. Cancellation and Changes Policy (Subject to Consumer Protection Law)

The Company's cancellation policy combines legal requirements and additional customer-friendly benefits provided by the Company.

A. Cancellation under Israeli Consumer Protection Law: A customer may cancel within 14 days from transaction date (or within 4 months for a person with disability, senior citizen, or new immigrant), provided the cancellation date is at least 7 business days before the service date.

Cancellation fee: 5% of the transaction amount or 100 NIS, whichever is lower.

B. Cancellation after the legal period or less than 7 business days before service: Where legal cancellation rights do not apply, the Company offers the following flexible policy.

Hotels and accommodation: Cancellation is allowed up to 24 hours before check-in with no cancellation fee (excluding processing fee). Cancellation under 24 hours before check-in incurs full cancellation fees.

Guided tours and excursions: Cancellation up to 7 days before service receives a full refund (less processing fee). Cancellation under 7 days before service receives only 30% refund of total tour cost.

Attractions and activities: Cancellation up to 5 days before service receives a full refund (less processing fee). Cancellation under 5 days before service incurs a 50% cancellation fee.

C. Non-refundable services: Services predefined as "Non-Refundable" (such as flight tickets or special events) are subject to full cancellation fees from the moment of booking.

6. Force Majeure

The Company shall not be liable for non-performance or delays caused by circumstances beyond its control (including war, pandemic, extreme weather, and similar events). In such cases, paid amounts will be transferred to an alternative date or granted as future credit, at the customer's choice.

7. Privacy and Intellectual Property

Privacy: User details are stored only for order operation needs and will not be shared with third parties (except suppliers). The user agrees to receive promotional messages and may unsubscribe at any time.

Intellectual property: All Website content (including images, routes, and logo) is the exclusive property of Make Your Travel. Copying or commercial use is prohibited without prior written approval.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel.

Exclusive jurisdiction is granted to the competent courts in the district of Bulgaria.
